PRIVATE SALE 4U
The terms and conditions set out here apply to the Private Sale 4U (PS4U) website.
By using PS4U online you agree to be bound by all of the terms and conditions here within.
These terms & conditions are affective from 1st November 2006 and may change at any given time without prior notice.
All classifieds and business advertisements are accepted on the following conditions.

01.1 PS4U is an internet-based classified and advertising business website intended to facilitate the sale of goods and services between private individuals and businesses. The service offering free classifieds is intended for non-commercial users and it success and utility is dependant on the co-operation of all users. Strict compliance with these terms and conditions is required.
01.2 PS4U will accept you as a registered user only if you are at least 17 years of age and older, and you are willing to abide by the terms and conditions here within.
02.
02.1 PS4U is not itself a contractor, agent or auctioneer to outside individuals that results a sales transaction facilitated through this site.
02.2 All transactions are conducted at sellers and buyers own risk where PS4U accepts no responsibility or liability for the quality or fitness of the goods or services advertised along with any exchange of goods and services, or the entitlement of any particular item, service or monetary value including barter-exchange.
02.3 PS4U is not liable for any loss or harm of any description either direct or indirect, arising out of/or in connection with any classified listing, business advertisement or transaction undertaken through the PS4U website.
02.4 The placement or publication of a classified listing or business advertisement by PS4U does not constitute a warranty that such submissions will be made due to matters beyond management control.
02.5 Where either a seller or buyer results a complication or where either party has any doubts at all concerning a transaction, independent legal advice should be sought.
02.6 PS4U intents to provide a high quality website that is both accessible and functional at all times within it’s control. However, it accepts no responsibility or liability to any party for any failure of the website resulting in partial or total unavailability for any period of time.
03.
03.1 PS4U is entitled to remove or alter any classified listing or business advertisement for any reason entirely at its discretion, including but not limited to any of the following circumstances:
a. Where content of the classified listing or business advertisement is or considered by PS4U to be objectionable, offensive, unlawful or defamatory.
b. Where there is reasonable cause to believe that the registered user placing classified listings has in the past engaged in any dishonest or unethical practices in relation to this or any similar website, or has in the past breached these terms and conditions.
c. Where there is reasonable cause to believe that the registered user placing free ad classifications is related with a commercial enterprise unsuited to the spirit and intent of the free service provided by PS4U.
03.2 The following items are considered prohibited content and will not be accepted as suitable submission:
Alcohol, tobacco and cigarettes
Lottery or raffle tickets
Firearms
Multi-level marketing schemes other than Amway, Avon & Melaleuca
Rare or endangered species
Illegal or pharmacal drugs
Child pornography
03.3 PS4U at its discretion will remove any registered person from its database due to the misuse of any of the circumstances outlined in 03.2.
03.4 PS4U may allocate any classified listing to a category of its choosing, whether or not that category was the registered user’s choice.
04.
04.1 Registered paid or unpaid users and business advertisers for the sale of goods or services agree to indemnify PS4U against all claims, losses or damages of any form, including any legal costs incurred, resulting from or connected with any particular classified or advertisement found on the website.
04.2 It is the responsibility of the registered user of any goods or services offered to ensure compliance within the law are meet.
04.3 By using PS4U the registered user agrees to honour the obligations incurred to any buyer and to act promptly the forwarding of the purchased item or service offered as agreed with the terms of sale.
04.4 No registered user or business advertiser shall engage in any form of conduct that may bring disrepute or cause damage of reputation to PS4U, its management or its agents.
05.
05.1 Young people in parental custody/guardianship may purchase goods or services advertised on PS4U only with the consent of their parent or guardian. PS4U will not be held liable for the purchase of any goods or services regardless of purchaser’s age.
05.2 The purchaser shall pay the vendor in full and promptly in all respects with the terms agreed at time of sale.
05.3 No purchaser shall engage in any form of conduct that may bring disrepute or cause damage of reputation to PS4U, its management or agents.
06.
06.1 The personal information provided at time of registration is used solely for purposes connected with the service provided by PS4U except where the person registering agrees to receive email information on new services, site updates and material which may be of interest.
06.2 In accordance with the Privacy Act 1993, any person in respect of whom PS4U possesses personal information may have access to that information and may require it to be corrected or deleted.
06.3 Registered users placing a classified listing with PS4U must take responsibility to ensure that contact details provided at the time of registration are correct, authorised by relevant guardian or business owner, and where such details within classifieds are limited to that as the registered user considers necessary to be made public.
06.4 PS4U may disclose personal information in its possession to outside parties only when it is required to do so under compulsion of law.
07.
07.1 Registered users, buyers and business advertisers using PS4U whether for selling or purchasing of goods or services, agree that PS4U management will not be a party to any dispute arising out of or in connection with any classified listing, business advertisement or related transaction, nor will PS4U management be required to participate in any formal or informal legal dispute resolution process.
07.2 All copyright works either it be literary, artistic or otherwise, created by PS4U for the display of any advertisement or website content is the property of PS4U.
07.3 Where any business advertisement includes a trademark or existing copyright work, the business advertiser warrants that it is authorised to deal with the trademark or copyright work in the manner been advertised.
07.4 Any failure or delay by PS4U to enforce any of these terms and conditions within does not constitute a waiver.
07.5 These terms and conditions may be amended at any time and becomes effective when published on the PS4U website.
07.6 These terms and conditions and other policies posted on the PS4U website constitute the entire agreement between you and the PS4U management and supersede any previous agreements.
08.
The acceptance of any classified submissions and advertisement is entirely at the discretion of PS4U management. PS4U reserves the right to refuse any classified submission or any other form of advertisement, to cancel any existing classified or advertisement on the grounds of objectionable content, misuse of the service provided and/or edit classifieds and advertisements if required.
09.
Classifieds and business advertisements must not contain material that is deceptive, misleading, discriminating or unlawful in any respect.
10.
The registered user or business advertiser agrees to indemnify the PS4U management, its servants and agents against any actions, claims, damages, costs or losses sustained by any of them that arise as a result of or in connection with the advertising of any material.
11.
While PS4U takes reasonable steps to ensure that on-line systems are secure and reliable, as too for all other mediums of communication be virus-free and operational, PS4U management shall not be liable for any direct, indirect or consequential losses resulting from any error, omission or inaccuracy in any classified or advertisement, or any computer virus contamination, whether caused by its own negligence or otherwise.
12.
PS4U does not guarantee the submission of any particular classified or advertisement on a specified date, or that on-line services will be available as considered normal operation, and does not accept liability for placement of any classified or advertisement beyond managements control. PS4U is not liable for any spelling mistakes, errors in placement or typographical errors in relation to any classified or advertisement beyond management control.
13.
Charges for business display advertisements are based on the set size as laid out by PS4U and may change at any given time without prior notice, as too for agent and/or dealer registration charges.
14.
The registered user and business advertiser agrees that PS4U may, at its discretion, publish, broadcast or make available all or part of the information supplied in any medium utilised by the PS4U for that purpose.
15.
To the extent that any business advertisement published for the purposes of the advertiser's business, the statutory guarantees provided for in the Consumer Guarantees Act 1993 shall not apply.
16.
The entire contents of this publication are copyright to DM King trading as Private Sale 4U. Reproduction, retransmission, or redistribution in whole or in part, or in any medium or form of content contained within this publication is prohibited unless approved in writing by DM King.
17.
PS4U may add or delete specific term and conditions amendments to these terms and conditions at any time, in which case the new terms and conditions shall be binding.
18.
Cancellation of business advertisements must be made at least 3 working days prior to insertion. If cancellation is made after this time, partial or full costs may be charged at the discretion of management.
19.
Business advertisers, registered agents and firms where payment for service is due, must make payment by the 20th of the month following the date of invoice/statement or as otherwise determined by PS4U.
20.
PS4U reserves the right to cancel without notice any contract in the event of failure to comply with these terms, or of payment not received after a specified period of 60 days, and where any classifieds or advertisements will be deleted from the site.
21.
The paid Registered User and Business Advertiser agrees that interest shall be paid on any outstanding account due at the rate of 15% per annum calculated on a daily basis from the date upon which payment falls due until the date of payment in full has been paid.
22.
The paid Registered User and Business Advertiser agrees to pay any further charges arising from the collection of any overdue debt including all legal costs and any other costs incurred in recovering the outstanding amount.
